Electronic Self Representations (eSR)

Electronic Self Representation (eSR) is an online tool to help individuals in the District of Colorado complete a chapter 7 bankruptcy petition when they have decided to file bankruptcy without an attorney.  This tool is not available for chapter 13 petitions.

FILING FOR BANKRUPTCY IS A SERIOUS MATTER.
 
It is strongly recommended that anyone considering filing bankruptcy seek legal advice and representation from an attorney experienced in bankruptcy law and procedure.  Only an attorney can give you legal advice regarding a bankruptcy case or proceeding.
 
eSR IS NOT FOR EMERGENCIES.
 
Do not use eSR if you are filing bankruptcy to stop a foreclosure action on your home, a repossession, or some other legal action.  The submission of a bankruptcy petition through eSR does not constitute a case filing. 
 
Your bankruptcy petition is NOT filed and you will NOT receive a case number until after the Bankruptcy Court receives all the additional required documents listed in your confirmation email.

Important Notes:
  • eSR is only available for Chapter 7 individual filings
  • eSR cannot be used for Chapter 13 petitions
  • eSR is not available to attorneys or bankruptcy petition preparers
  • eSR is not designed for business or corporate bankruptcy filings
Upon submission of the electronic bankruptcy package, the Clerk will send you an email confirmation.  This confirmation email contains instructions for the submission of the additional required items that are needed before we can file your bankruptcy petition.  It is important to understand that your bankruptcy case is not filed unless and until the court receives these required additional items.
 
There is no cost to use eSR.  Pay only the chapter 7 bankruptcy filing fee.  eSR has a guided step-by-step process that allows up to 45 days to complete your package and submit.  Your personal information is only accessible to you using a unique login and password.  eSR is available 24 hours a day from any internet-enabled computer.  You need a valid email address and internet access.  It is recommended that you use the latest version of Mozilla Firefox, Internet Explorer, Chrome or Safari for the program, and Adobe Reader (version 8 or higher) to view .pdf documents.
 

Getting Started and Using eSR

  • Obtain credit counseling from a court-approved credit counseling agency.  The law requires credit counseling within 180 days before the bankruptcy filing date.  For a list of approved agencies click HERE.
  • Collect all financial documents before you begin, such as:
    • A list of real property (real estate) you own, it's value, and a mortgage statement showing current loan balance.
    • A list of personal property (e.g., household goods, vehicles, jewelry, etc.) you own and their values.
    • Names and addresses of all the people to whom you owe money.
    • Income documentation such as pay stubs, W-2s, or proof of income from other sources such as social security, disability, etc.
  • Start using eSR by clicking HERE.
    • Create a user profile, login, and password.
    • Answer questions about your property, income, and debts.  When you are finished, hit submit.
Upon your submission of the Electronic Bankruptcy Package, you will be sent an email confirmation.  This confirmation contains important instructions for the submission of additional items identified below that are required to complete your bankruptcy filing.  It is important to understand that your bankruptcy case is not filed unless and until the Court receives these required additional items.
 

Additional Required Items: After eSR Submission and Before Case is Filed and Case Number Issued

You must provide the Clerk with the following additional items.  They must be completed, signed, and either delivered by mail, provided to the Court in-person during regular business hours or via the after hours drop boxes located in the courthouse.  If the Clerk does not receive your additional items, then your Electronic Bankruptcy Package will not be processed.

If you are married and your spouse is filing with you, then both you and your spouse must complete and sign both the Signature and Declaration Form and Statement About Your Social Security Numbers (Official Form 121).

An automatic stay (injunction) is NOT in effect until a bankruptcy case number is issued by the Court.  The Clerk will mark your case filed and a case number will be issued after the Signature and Declaration form and Statement About Your Social Security Numbers are received.

Additional Required Items: Within 14 Days After Filing

These items must be submitted within 14 days after a case is filed or the case may be dismissed by the Court.  You must deliver them in person to the Clerk's Office during regular business hours, by mail, or via the after hours drop box (open until 6 pm M-F except federal holidays) located at the US Custom House, 721 19th street, Denver:
