IN THE MATTER OF
THE IMPLEMENTATION OF
THE ASSIGNMENT OF CASES
GENERAL PROCEDURE ORDER NUMBER 1996-1
Insofar as practicable and efficient, cases shall be assigned to judges by
random selection and work parity among the judges shall be maintained. Whenever a majority
of the judges determines that a workload imbalance is affecting parties adversely, the
chief judge shall review the pending case loads of the judges and suggest appropriate
reassignment of existing cases. The chief judge may also, if the chief judge determines
that a reassignment of a case or cases is necessary or appropriate to more effectively and
efficiently administer such case or cases, reassign cases with the consent of the affected
judges. All reassignments or transfers of cases from one judge to another shall be subject
to the chief judge's approval.
The clerk shall review page two of the petition to determine if the attorney or pro se
party filing a bankruptcy case has indicated, in addition to other information required,
whether the case being filed is "related" to any other case then pending before
the court, or whether the petitioner has filed a prior bankruptcy in Colorado in the last
six years.
Related Cases: If the case being filed appears to be "related" to another
pending case, the case being filed shall be referred to the judge with the earliest filed
case who shall determine if the case is "related." If the case is related, that
judge shall enter an order directing the clerk to reassign the case to that judge for
further proceedings. If found not related, the case shall be returned to the clerk. For
the purposes of this order, a case is "related" to another case if one of the
debtors in one case is an affiliate or an insider of a debtor in another case.
Sequential Cases: If the petition reflects that the debtor has filed a prior bankruptcy
case in the last six years, the clerk shall assign the case to the judge to whom the last
prior bankruptcy case was assigned. If the automated data base reflects that the debtor
has filed a prior bankruptcy case in the District of Colorado in the last six years, the
clerk shall reassign the new case to the judge to whom the last prior filing is assigned.
In the event of assignment or reassignment pursuant to this order, the clerk shall adjust
the random assignment deck accordingly.
