New Claims Transfer Fee to Take Effect May 1, 2013

Effective May 1, 2013, the bankruptcy courts will begin charging a new fee of $25 for each claim transferred. This fee was approved by the Judicial Conference of the United States at its September 2012 session. Please click here for more information.

Pursuant to 28 U.S.C. § 2071, Rule 83 of the Federal Rules of Civil Procedure and Rule 9029 of the Federal Rules of Bankruptcy Procedure this General Procedure Order is adopted to make revisions to certain Local Bankruptcy Rules (L.B.R.) and Local Bankruptcy Forms (L.B.Forms), and add to the L.B.R., pending their formal adoption. This GPO will be effective February 1, 2013, it covers minor revisions to the Local Bankruptcy Rules dealing with Chapter 11 cases and creates a new rule and form when receivers are involved. Consistent with the mandatory electronic filing requirements of L.B.R. 5005-4, this General Procedure Order clarifies that mandatory electronic filers also are required to process fee payments through the electronic filing system. Please remember that the Court will only accept the efiling attorney or the law firm's credit card to process the payments. Effective December 17, 2012, this applies to all installment payments due or to be made in any cases filed by efiling attorneys, please contact the ECF Training Team with questions.

General Procedure Order 2012-1 (GPO) contains the list of all cases reassigned from Standing Chapter 13 Trustee Sally Zeman to Douglas Kiel effective February 1, 2012 and the administrative procedure to effectuate the change. In addition, amended wage orders will enter in those reassigned cases that have wage orders for employers. Payments in all of the reassigned cases should be mailed payable to the order of Douglas B. Kiel, Chapter 13 Trustee, P.O. Box 2282, Memphis, TN 38101-2282. This second GPO covers most open Chapter 13 cases from 2010 and 2011 (with select 2009 cases) from the counties that have been assigned to Trustee Kiel. Specifically, the counties are: Mineral, Alamosa, Baca, Bent, Chaffee, Conejos, Costilla, Crowley, Custer, Fremont, Huerfano, Kiowa, Las Animas, Otero, Prowers, Pueblo, Rio Grande, Saguache, El Paso, Teller, Arapahoe, Cheyenne, Denver, Douglas, Elbert, Kit Carson, Lake, Lincoln and Park. There are several Federal Rules of Bankruptcy Procedure changes, some with corresponding new or revised forms. The Rule and Forms changes are posted at: http://www.uscourts.gov/FormsAndFees/Forms/BankruptcyForms/BankruptcyFormsPendingChanges.aspx. Please pay particular attention to changes to Rule 3001 and the addition of Rule 3002.1 which relate to proofs of claims and supplements, etc., required in applicable individual debtor cases. In order to implement the new rules and forms, there will be additional filing events added in ECF: Notice of Mortgage Payment Changes. Form B 10 (Supplement 1)(12/11); Notice of Postpetition Fees, Expenses, and Charges. Miscellaneous Fee Increase - Effective November 1, 2011

At its September 13, 2011 session, the Judicial Conference of the United States approved a recommendation of its Committee on Court Administration and Case Management amending the miscellaneous fee schedules for the courts of appeals, district courts, bankruptcy courts, U.S. Court of Federal Claims, and Judicial Panel on Multidistrict Litigation to increase certain fees for inflation, to be effective November 1, 2011. Electronic Public Access Fee Increase - Effective April 1, 2012

In September 2011, the Judicial Conference of the United States authorized an increase in the Judiciary's electronic public access fee in response to increasing costs for maintaining and enhancing the electronic public access system. The increase in the electronic public access (EPA) fee, from $.08 to $.10 per page, will take effect on April 1, 2012. The change is needed to continue to support and improve the Public Access to Court Electronic Records (PACER) system, and to develop and implement the next generation of the Judiciary's Case Management/Electronic Case Filing system. Discontinuance of Mailing of Proof of Claim Forms Effective October 1, 2011.

Effective October 1, 2011, we will no longer include a Proof of Claim form with Notices of Meetings of Creditors or Chapter 7 notices establishing a claims deadline. This change has been mandated by the Administrative Office of the U.S. Courts as a cost-savings measure and after a study determined that less than 5% of the Proof of Claims included with the Court's notices were returned. The majority of the claims that are filed are created electronically by the creditor's software or though other electronic forms creation tools. Proofs of Claim forms are available on the US Court's website, www.uscourts.gov, on our website, or at the Intake Counter of any bankruptcy court. Telephonic Appearance Information

Please note that being allowed to appear telephonically at a hearing is a privilege that will be revoked if the Court cannot obtain an accurate record. In order to allow the Court to make a proper electronic recording of its proceedings when parties appear telephonically we must require the following from participants:

eliminate all excessive noise (including, but not limited to: typing, background conversations, barking dogs, traffic, wind, music, etc.);
do not use cellular phones, they are more susceptible to background noise and have issues with clarity, use a land line if at all possible; and
do not use speakerphones as they cause incredible and annoying feedback in the courtroom.

Participants who have excessive background noise, lack clarity or who are causing feedback into the courtroom risk being disconnected and excluded from the hearing.

U.S. Trustee's New Address for Meeting of Creditors in Denver

As part of the ARRA construction, the UST is moving the meeting of creditor locations for Denver. We would like to assist in alerting the practitioners, as you will notice a different address on the meeting notices and a different reference on the docket sheet.

Beginning in February there will be a new location for Denver meetings of creditors as follows:

For Chapter 7 cases: Beginning on February 1st the location for all Denver 341 meetings will be:

There is a new chapter 13 email address designed solely for the Debtor's submission to the Trustee of the tax return/affidavit required to be provided by 11 U.S.C.521(e)(2)(A)(i). Providing the return by email will save copies and postage and will allow the Trustee to monitor her receipt of the returns more efficiently. Please advise your staff or client to provide the return/affidavit to taxreturns@ch13colorado.com
