Instructions on filing the declarations and affidavits required by GPO 2005-2
(Servicemembers Civil Relief Act of 2003)

Please note that there are two possible ways for debtors to comply with GPO 2005-2 regarding the declaration requirements for the Servicemembers Civil Relief Act of 2003 ("SCRA"), effective August 1, 2005. The first option, at the time of filing the petition, you may submit the scanned version of the declaration as the last page of the voluntary petition packet, it should follow the verification of the creditors matrix. The second option, which can be done at the outset or as an amended for changed circumstances or otherwise, it can be filed as a separate pdf by using the event "SCRA Declaration" found under the Miscellaneous Category.

Regarding the affidavit that should accompany motions for relief from the automatic stay and for default judgment, there are two ways to comply. First, include it as the last page of the motion. Second, if filed separately, use the event "Affidavit" found under the Miscellaneous Category.

Both the SCRA Declaration and Affidavit may be submitted electronically with electronic signatures, however, you are required to retain the original signature in your files according to GPO 2001-8.
