Revised Chapter 13 Procedures (July, 2007)
Changes include:
-- Initial confirmation hearings will be held in all cases, regardless of whether objections are filed, unless a Verification of Confirmable Plan is filed no later than three court days prior to the hearing.
-- Counsel who do not timely file all documents required by T.L.B.R. 3015-1 are required to appear for the initial confirmation hearing IN PERSON, including counsel located in Colorado Springs or Pueblo.
-- Only counsel who have timely filed all required documents will be allowed to appear telephonically.
-- Judge Brown may, at her discretion, conduct the initial confirmation hearings rather than the law clerk.
-- All amended plans should be filed with a T.L.B.R. 3015-1(d)(3) certificate describing the amendments in detail.
-- Confirmation of the original plan will be denied after the initial hearing if an amended plan has been or will be filed.
Certificate Regarding Plan Objections/Certificate Regarding Amended Plan When No Objections Filed to Original Plan - Suggested Forms will be posted in the future. Until forms are posted, Debtors' counsel may use their own form containing the information specified in the Revised Chapter 13 Procedures for Courtroom F, or, alternatively, may use the suggested form posted on Judge Tallman's website.
